Wage Range: $98,196 to $132,579

Starting Wage: $98,196 to $115,398 based on qualifications/experience

Status: Full-Time, Exempt

POSITION SUMMARY

Works under the broad policy guidance and direction of the City Attorney. Performs entry to journey level professional duties as required to carry out the efficient and effective litigation of civil or criminal cases and the ongoing legal processes of city government. Represents Kaysville City in assigned legal matter as a plaintiff or defendant. May provide supervision to support staff assigned to the Legal Department on a project-by-project basis.

ESSENTIAL DUTIES AND RESPONSIBILITIES

  1. Promotes and follows the City's mission statement, values, and expectations.
  2. Meet performance standards established with the employee's manager.
  3. Job attendance is required, except for authorized leave. Some essential job duties may be performed from a remote location with approval.
  4. Meaningfully engage with and provide legal advice, strategies, and ideas to the Office of the City Attorney and other City Staff, coordinating and performing all work activities in a manner consistent with the City's Service Values, with the end of accomplishing the mission of the City.
  5. Formulate, develop, and carry out all work within applicable City policies and applicable law.
  6. Prosecutes criminal cases as assigned; represents the city of Kaysville in prosecution and defense of various criminal and civil cases; institutes arrest proceedings; prepares case materials; participates in various examination processes such as discovery and briefings; researches and writes briefs; appears in court and presents evidence and arguments.
  7. Manage outside legal counsel engaged to represent the City.
  8. Review and advise Risk Management regarding claims against the City.
  9. Attend Planning Commission meetings and provide legal advice.
  10. Perform legal research, including extensive analysis of legal positions; determine and apply legal principles and precedents to problems and issues.
  11. Research and update knowledge of case laws and statutes.
  12. Prepare ordinances, resolutions, contracts, leases, and memoranda for consideration and approval.
  13. Initiate and prosecute actions to protect the City's interests, including preparation of pleadings and briefs, oral argument, conducting trial and plea negotiations, responding to appeals, appearing in court for motions, changes of pleas and sentencing, settlement negotiations, and reviewing performance of defendants after conviction.
  14. Monitors and reviews activities in the city when assigned to assure compliance with statutory and legal requirements.
  15. Evaluates assigned department policies and procedures and develops changes consistent with legal requirements and current management practices; attends workshops and professional seminars to keep current on legal issues.
  16. Performs related duties as required.

MINIMUM QUALIFICATIONS

Education and Experience:

  1. A Juris Doctor degree from an accredited college or university, OR
  2. The ability to obtain a Juris Doctor degree by August 1, 2025, AND the ability to practice under the Temporary Practice rules of the Utah State Bar.

KNOWLEDGE, SKILLS & ABILITIES

  • Working knowledge of federal, state, and local laws and ordinances; legal administrative procedures including the rules of civil and criminal procedure and evidence; the principles, methods, materials, and practices used in legal research; Utah Code, constitutional provisions and local ordinances as they apply to city government and its operation; case law related to a variety of city government subjects; criminal law issues.
  • Ability to analyze and draft legal documents and propose legislation; ability to establish and maintain effective working relationships with city and court officials, employees, and the public; ability to communicate effectively, verbally and in writing.

SPECIAL REQUIREMENTS

  • Must possess a license to practice law in the State of Utah; OR Obtain that license within 6 months from the date of employment.
  • Must possess a valid Utah State Driver's License and meet the requirements of the City's Motor Vehicle Policy.

TOOLS AND EQUIPMENT

Audio and visual equipment, computer, calculator, telephone, printers, scanners, and copier. Must be able to receive and send emails, text, and other messages from a mobile device.

Physical: Typical office setting with appropriate climate controls. Common eye, hand, finger dexterity exist. Mental application utilizes memory for details, verbal instructions, emotional stability, discriminating thinking and creative problem solving. Periodic travel required in normal course of job performance. Position subject to random drug and alcohol testing.
